TM says its 5G access termination with DNB is valid, to pursue appropriate processes to settle dispute

Telekom Malaysia Berhad (TM) has responded to Digital Nasional Berhad’s (DNB) rejection of its early termination notice, maintaining that it has exercised its contractual rights in full compliance with the 5G Access Agreement (AA) signed over 3 years ago.

In an official statement, TM said it takes note of DNB’s media statement regarding the 5G Access Agreement.

TM said it has exercised its contractual rights under the 5G AA “strictly in compliance with the specific conditions governing early termination and applicable requirements,” which it said is related to the implementation of the 5G Dual Network Model.

The company added that the decision to terminate the agreement was made following “a thorough analysis of all legal rights and obligations as per the AA.”

TM insists that its termination notice is valid and said it has reserved all its rights.

The telco giant also stated that the AA provides mechanisms for resolving any differences in interpretation between the parties, and that it will pursue the appropriate processes under the agreement.

To assure Unifi Mobile customers, TM said, “Our priority remains ensuring uninterrupted service for our customers, while we manage this transition in a phased and orderly manner.”

To recap, TM recently signed a 3-year 5G wholesale agreement with U Mobile which allows them to provide 5G services using Malaysia’s second 5G network. At the same time, TM announced an early termination of its existing 5G access agreement with DNB.

DNB said today that it does not accept TM’s notice to terminate the 5G access agreement, stating that TM had not exercised its early termination rights in accordance with the specific conditions of the agreement. DNB maintains that the 10-year agreement remains valid, binding and enforceable.

TM is one of the first telcos in Malaysia to sign up for 5G access with DNB. Under the signed 5G Access Agreement, DNB will provide the National 5G Wholesale Network Product to TM for a period of 10 years from 7th October 2022 until 6th October 2032.
